1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of hundredmileoutdoor.com, including all content, products, and services offered on or through the site (collectively, the “Site”), operated by Hundred Mile Outdoor LLC (“Hundred Mile Outdoor,” “we,” “us,” or “our”). By accessing or using the Site, creating an account, submitting an inquiry, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

2. Changes to These Terms

We may revise these Terms from time to time. The updated version will be indicated by a revised “Effective Date” and will be effective as soon as it is posted. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

3. Who May Use the Site

The Site is intended primarily as a resource for architects, interior designers, and other design professionals, as well as their clients and other adult visitors. By using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. The Site is not directed to children, and we do not knowingly permit use of the Site by anyone under 16.

4. Accounts

Certain features of the Site — including the “My Account” area, order history, and “Saved Items” wishlist — may require you to register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Keep your login credentials confidential and restrict access to your account; and
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or unlawfully.

5. Products, Content, and Pricing

The Site displays a curated catalog of outdoor furniture, lighting, and related products sourced from manufacturers and brands represented by Hundred Mile Outdoor, along with product images, specifications, and downloadable documentation.

  • Product descriptions, images, dimensions, materials, and availability are provided for informational purposes and, while we strive for accuracy, may contain errors or be subject to change without notice. Actual products may vary slightly (e.g., due to natural material variation) from images shown.
  • The Site does not display retail pricing and instead operates on a trade/quote basis. Pricing is available upon request/quote and is subject to confirmation at the time of order.
  • We reserve the right to limit quantities, refuse orders, discontinue products, or modify the catalog at any time, at our sole discretion.

6. Quotes, Orders, and Payment

[This section should be finalized once the Site’s actual ordering process is confirmed — e.g., whether orders/quotes are placed and paid for directly through the Site’s cart and checkout, or whether the Site’s cart/account tools are used to build a request that is fulfilled via a separate sales process (invoice, purchase order, etc.).   • Submitting a quote request, or inquiry through the Site (including via the cart, checkout, or “Get In Touch” form) is an function to inquire about the applicable products, subject to acceptance by Hundred Mile Outdoor. We reserve the right to accept or decline any quote request, in whole or in part, for any reason, including product availability, errors in pricing or product information, or concerns about fraud.
  • Many products offered through Hundred Mile Outdoor are custom, made-to-order, or special-order items with manufacturer-specific lead times, deposit requirements, and cancellation policies. We can provide the details of policies when developing a order quote.

7. Shipping, Delivery, Title, and Risk of Loss

Shipping and delivery timeframes are estimates and will be provided when finalizing your order. Unless otherwise agreed in writing, risk of loss and title to products pass to you upon delivery to the carrier or, for white-glove delivery, upon delivery to the specified location.

8. Returns, Cancellations, and Custom Orders

Because many products are custom-made, made-to-order, or special-order through third-party manufacturers, such orders are typically non-cancellable and non-refundable once production has begun, except as required by law or as otherwise stated in writing at the time of order. Standard-stock items, if any, may be subject to a different return policy, which will be provided at the time of sale.  These policies will be shared when developing your quote.

9. Wishlist / Saved Items

The “Saved Items” feature allows registered users to save products of interest for future reference. Saving an item does not reserve inventory, lock in pricing, or constitute an order. Saved Items lists may be tied to your account and, where applicable, to cookies used to maintain your session; see our Privacy Policy for details.

10. Intellectual Property

All content on the Site — including text, graphics, logos, product photography, layout, and the compilation and curation of the product catalog — is owned by Hundred Mile Outdoor or its licensors (including the manufacturers whose products are featured) and is protected by copyright, trademark, and other intellectual property laws. Product names, brand names, and logos of manufacturers featured on the Site belong to their respective owners.

You may view, download, and print content from the Site solely for your own personal or internal business reference in connection with a genuine design/specification project involving Hundred Mile Outdoor products. You may not otherwise reproduce, distribute, modify, publicly display, republish, or create derivative works from any Site content, or use any Hundred Mile Outdoor trademarks, without our prior written consent. Downloadable product documentation (e.g., spec sheets) is provided for project use and may not be redistributed as your own or repurposed for a competing business.

11. User Conduct

When using the Site, you agree not to:

  • Violate any applicable law or regulation;
  • Submit false, misleading, or fraudulent information through the contact form, account registration, or checkout;
  • Attempt to gain unauthorized access to the Site, other users’ accounts, or our systems;
  • Interfere with or disrupt the Site’s functionality, security, or servers, including through the introduction of malware or automated scraping tools;
  • Copy, scrape, or harvest product data, images, or pricing for use in a competing catalog or directory; or
  • Use the Site for any unlawful, harassing, or fraudulent purpose.

We reserve the right to suspend or terminate your access to the Site, including your account, for any violation of these Terms.

12. Third-Party Links and Services

The Site may link to third-party websites and services, including social media platforms (e.g., Instagram, Facebook) and manufacturer websites. We do not control and are not responsible for the content, policies, or practices of any third-party sites. Your interactions with those sites are solely between you and the third party.

13. Disclaimers

THE SITE AND ALL CONTENT, PRODUCTS, AND INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN A MANUFACTURER’S WARRANTY OR AS REQUIRED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCT DESCRIPTIONS, IMAGES, OR PRICING ARE ACCURATE, COMPLETE, OR CURRENT. PRODUCT WARRANTIES, IF ANY, ARE PROVIDED BY THE APPLICABLE MANUFACTURER SUBJECT TO ITS OWN TERMS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HUNDRED MILE OUTDOOR AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HUNDRED MILE OUTDOOR FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify, defend, and hold harmless Hundred Mile Outdoor and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any rights of a third party.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to the Site shall be governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and any order-specific terms (such as a quote, invoice, or purchase order) agreed to in writing, constitute the entire agreement between you and Hundred Mile Outdoor regarding your use of the Site and supersede any prior agreements regarding the same subject matter.
